These terms govern use of this website and the HopeConnect platform. Organizations running a pilot also sign a separate written agreement, and where the two differ, that agreement controls.

The agreement

By using this website or the HopeConnect platform, you agree to these terms. Organizations participating in a pilot or subscription also enter a separate written agreement with us, which may include a business associate agreement. Where that agreement conflicts with these terms, that agreement controls for that organization.

What the service is, and is not

HopeConnect is referral coordination infrastructure. It organizes, flags, matches, and routes referrals between organizations, and records their progress.

It is not a medical device, a clinical decision support system, or a provider of healthcare. It does not diagnose, triage, assign acuity, or determine what care a patient should receive. It is not an electronic health record and is not a system of record for clinical care.

Clinical responsibility

Clinical judgement remains with licensed professionals and their organizations at all times. Deciding whether a referral is appropriate, whether to accept a patient, and what care to deliver are decisions the platform does not make and cannot make. Where the platform presents inferred rather than verified information, it labels it, and it remains your responsibility to confirm before acting. The platform is not a crisis or emergency service and must not be relied upon for urgent clinical communication.

These clauses require your counsel. Do not publish this page until they are drafted.

The following need to be written or approved by a lawyer familiar with your corporate structure, insurance, and risk position. We have deliberately not drafted placeholder language, because plausible-sounding legal text is worse than none: warranty disclaimers and any service level commitments; limitation of liability and its cap; indemnification; intellectual property and licence grants, including rights in provider-submitted content and any aggregated or de-identified data use; term, suspension, and termination, with data return and deletion; governing law and venue; dispute resolution, including any arbitration or class action waiver; changes to the terms and how notice is given; force majeure; assignment; and the entity name and registration details that should appear.
